Terms of service
Last updated October 16, 2026
These terms govern your use of Hermes. By creating an account you agree to them.
1. The service
Hermes is in public beta: features may change, break or be removed, and the service may be unavailable at times. It is provided “as is”, without warranties of any kind, to the extent the law allows.
2. Your account
You must be at least 16 and give accurate information. You are responsible for activity on your account and your devices. Revoke any device you lose from the Devices screen.
3. Your assistant acts for you
Hermes takes actions you ask for, in accounts you connect. You remain responsible for those actions. Review mode and approvals let you decide what Hermes may do without asking; payments always need your signed approval within your caps.
3a. Payments
When Hermes needs to pay for something, it asks you with a payment card showing the merchant, items, total and the card it will use. Nothing is charged unless you approve that exact request on your device (passkey, Face ID or fingerprint), within your limits. Your bank may ask you to confirm (3-D Secure). The card is first authorized and then charged only when the purchase is made, for no more than you approved; unused authorizations are released. You can see every payment, its receipt and refunds in the app. If the final price is higher than what you approved, Hermes must ask you again. During the beta, payments run in test mode and no real money moves; before real payments are enabled we will update these terms, including who the merchant of record is and how disputes are handled.
4. Acceptable use
Do not use Hermes to break the law, harm others, send spam, infringe rights, attack systems, or evade the terms of the services you connect. We may suspend accounts that do.
5. Third-party services
Connections (for example Google, Slack, Claude Code or Codex) are governed by those providers’ terms. You are responsible for complying with them, including any limits on using your subscription in an automated assistant.
6. Your content
You own your content. You give us the limited permission needed to store and process it to run the service for you.
7. Plans, fees and the free trial
Plans. Hermes has a Free plan and paid plans (Plus and Pro), billed monthly or yearly in Canadian dollars, plus any applicable taxes. Current prices and what each plan includes are on the Pricing page.
Free trial. Paid plans start with a one-month free trial. A valid payment card is required to start it. One free trial per person, account and card; we may decline a trial that looks like a repeat. We remind you at least 3 days before the trial ends. Unless you cancel before it ends, the trial converts automatically to the paid plan and your card is charged the plan price when it ends (on day 31), and then at each renewal.
Automatic renewal. Paid plans renew automatically at the end of each billing period (month or year) until you cancel. By starting a paid plan you authorize us, through our payment processor Stripe, to charge your card for each period.
Changing plans. An upgrade takes effect immediately and you are charged the prorated difference for the rest of the current period. A downgrade or a switch between monthly and yearly takes effect at the start of the next period.
Cancelling. You can cancel any time in Plan & billing. Your plan stays active until the end of the period you paid for (or the end of your trial), with no further charges, and you can resume it until then. Afterwards your account moves to the Free plan; your Hermes and its data are kept.
Refunds. Fees are billed in advance and are non-refundable, and we don’t give refunds or credits for partial periods or unused time, except where required by law (for example, consumer protection laws where you live). If we end a paid plan for a reason other than your breach of these terms, we refund the unused part.
Failed payments. If a payment fails we retry it for a limited time and let you update your card. If it still can’t be collected, your account moves to the Free plan; nothing is deleted.
Price changes. We will tell you at least 30 days before a price change for your plan; it applies from your next renewal and you can cancel before then.
While Hermes runs payments in Stripe’s test mode, no real charges are made.
8. Liability
To the extent the law allows, our total liability for any claim relating to Hermes is limited to the greater of CA$100 or the fees you paid us in the 12 months before the claim, and we are not liable for indirect or consequential losses.
9. Ending
You can delete your account at any time (cancel any paid plan first so it doesn’t renew). We may stop offering Hermes or end your access with reasonable notice, and will let you export your data where possible.
10. Changes
We may update these terms; we will tell you in the app before material changes apply.
